Not Guilty Plea and Advisement of Rights - Request for Court Trial

When you plead not guilty, the court will schedule you for a trial before a judge, where you can present your facts and evidence pertaining to your citation.  The officer who cited you will also be notified of the court date and will attend your trial to present the reasons for your citation.  

Once you have submitted the webform below, please take no further action until you have had your trial.  You should not sign up for traffic school, submit fine payments or request fine reductions while your case is pending.   When you attend your court trial, if you are found guilty by the court, you can request traffic school, fine reductions, charge dismissals or other relief while the judge is determining the terms of your conviction.

I understand that I have the following rights:

TO THE ASSISTANCE OF AN ATTORNEY AT MY OWN EXPENSE. 

TO A SPEEDY AND PUBLIC TRIAL BEFORE A JUDGE.  To present evidence and call witnesses at the trial.  In that regard, to have the clerk issue a subpoena without charge to compel witnesses to attend the trial and for the production of documents helpful to my defense.   

TO CONFRONT AND CROSS-EXAMINE MY ACCUSERS.  This is, to see, hear and question the witnesses against me at the time of trial. 

TO PRESENT EVIDENCE TO SHOW THAT I AM NOT GUILTY OF THE OFFENSE. 

TO REMAIN SILENT AND NOT INCRIMINATE MYSELF.   I understand that I do not have to testify at the trial unless I choose to do so.

*TO HAVE MY CASE TRIED WITHIN 45 DAYS, unless I give up (waive) that right.  The 45 day period begins to run upon entry of this NOT GUILTY plea.
